This webinar will focus on how banking has changed in the last few years and how some of those changes have created efficiency opportunities and ethical challenges that fiduciaries should address with good policy and procedure for themselves and their agency. Some topics covered will include online access to client accounts, non-check transactions, and local bank branch limitations. The talk will also cover the Patriot Act/Know Your Client law and how that change impacts the fiduciary relationship with the bank and the account, including a focus on how this one change alone creates a problem with what used to be considered ethical banking practice. There will be discussion on how to craft a policy and procedure that highlights the new rules and sets forth how the guardian will apply them to their practice in a consistent manner.

Attendees will learn what some of the new rules are in fiduciary banking and will receive some tips on how to create policies and procedures that reflect these new rules.

Intended Audience:  Primarily professional fiduciaries who handle multiple clients, but a guardian with a single client (or family member) might learn what to expect from a bank when they need to open a new account.

Presenter: Leesa Arthur

Leesa Arthur is a Washington State Certified Professional Guardian who has been working as a professional fiduciary since 1994. During the intervening years, she has gained experience in the areas of managing and reworking guardianships, special needs and settlement trusts, guardian ad litem investigations, probate administration, and developing education opportunities for other guardians. She is currently the director of Summit Guardian Services, an agency that focuses on VA fiduciary work, small trust administration, and unique guardianships, mostly those with actively involved family.
